Terms of Service

and then… · Virgos Ventures Ltd.

Effective date: 4 October 2026. Last updated: 4 October 2026.

These Terms govern your use of the and then ... mobile app provided by Virgos Ventures Ltd. ("we", "us" or "our"). They cover the app and optional support payments, not our other apps or browsing andthen.today.

Please read them before using the app. By using the app after these Terms have been made available to you, you agree to them. If you do not agree, do not begin using the app. If you already have journal content, save a copy before removing the app.

Our Privacy Policy explains how information is handled. Agreeing to these Terms is not consent to optional data processing.

1. Who can use the app

You must be at least 13 years old to use the app. If local law requires a higher minimum age for your use, that higher age applies.

If you are under the age at which you can enter a binding agreement where you live, you may use the app only with a parent or guardian's agreement and where local law permits. Any parental authorisation required for consent-based processing must also be obtained through a legally valid process; this clause does not replace it. A parent's permission does not make the app available to children under 13.

The app requires no sign-up or account with us. Downloading it and making a support payment can require an account with Apple or Google and are subject to their rules.

2. What the app provides

and then ... is a personal journal for recording and revisiting moments using sentences, writing and optional media or other details. Features may vary by device, operating-system version and country.

The current app is free to use. Optional support payments do not unlock features or give preferential access. Complete journal export, including attachments, is free and does not depend on a payment.

The app stores your journal locally. We do not provide cloud journal storage, cross-device sync or a remotely recoverable copy of your journal. Phone backups and files you save yourself are described in section 5.

The app is a journaling tool, not a medical, therapeutic or emergency service. Mood labels, prompts and connections between moments do not diagnose conditions or provide professional advice. We do not monitor entries or provide an emergency response.

3. Your licence to use the app

We give you a limited, non-exclusive licence to install and use the app for your personal journaling on compatible devices you own or control, subject to these Terms and the applicable app-store rules. The app is licensed, not sold.

We and our licensors retain rights in the software, design, branding and supplied materials. This does not give us ownership of your journal. Third-party and open-source components remain subject to their own applicable licences and notices.

You must not unlawfully copy, sell or distribute the app, interfere with its security, introduce malicious code, or use it to infringe another person's rights. Restrictions on modification, reverse engineering or similar activities do not apply where the law or an applicable open-source licence permits them.

For an iOS download, Apple's Standard Licensed Application End User Licence Agreement also applies to the software licence unless a custom EULA is separately provided in the App Store. These Terms supplement that licence and do not replace it or override Apple's applicable Usage Rules. Mandatory consumer rights remain unaffected.

4. Your content, permissions and lawful use

Ownership and permission to operate the app

You keep the rights you have in your writing, photos, recordings, drawings and other content. We do not claim ownership of it.

You permit the app to store, display, organise and copy content on your device, and to export or share the content you choose when you use those features. This is limited to providing the requested functionality. It is not permission for us to publish your journal, use it in advertising, train AI on it or sell it.

Your responsibility for content

You are responsible for the writing, images, videos, audio, drawings and other material you create, import, store, copy or share using the app, and for ensuring that your use is lawful. You must own the relevant rights, have the necessary permission, or be entitled to use the material under an applicable legal exception. Being able to access a file on your device or online does not by itself give you permission to copy or distribute it.

You must respect copyright and other intellectual-property rights, privacy, confidentiality and applicable recording laws. Obtain any consent the law requires before photographing, filming or recording another person, or sharing their image, voice, location or private information. Permission to make or privately keep a recording does not necessarily include permission to share it.

Prohibited content and conduct

You must not use the app to:

  • Create, possess, import, store or distribute material where doing so is unlawful, including child sexual abuse material.
  • Create or share intimate images or recordings without consent where required by law, or otherwise engage in unlawful image-based abuse, including through manipulated or synthetic material.
  • Infringe another person's intellectual-property rights, unlawfully disclose confidential or personal information, or unlawfully publish defamatory material.
  • Threaten, stalk, harass, extort or defraud someone, or encourage or facilitate unlawful violence or other criminal activity.
  • Distribute malicious files or attempt to gain unauthorised access to another person's device, journal or information.

These rules do not prevent lawful private journaling about difficult experiences, distress, sexuality or wrongdoing. Recording an account of an event is different from using the app to carry out or facilitate unlawful conduct.

Our role and content concerns

Your private journal is not a public feed hosted by us. We do not receive or routinely review its contents, and we do not approve, verify or endorse user-created material. The app's ability to import, display or share a file is not a determination that the file or its use is lawful, accurate or safe. App branding or credit attached to a share is not our endorsement of that content.

We do not have remote access that lets us inspect or remove content from your device or recall copies sent through other services. These practical limits do not remove any obligation the law imposes on us. A serious breach may lead to termination of your licence as described in section 10; this does not imply that we can remotely disable your installation or erase its content.

You may contact us about an alleged infringement or unlawful use using the details in section 13. Describe the concern and the relevant circumstances; do not send illegal files or another person's private journal archive. We will assess matters within our control and respond to valid legal requirements. If material has been published or sent through another service, its provider controls any removal from that service. Any information we actually hold is handled as described in the Privacy Policy.

5. Storage, protection, backup and deletion

Your journal depends on the device and the copies you keep. We cannot recover it from our servers if you lose your device, delete data or cannot access a usable backup.

Phone-backup eligibility is enabled by default and can be changed in Settings → Privacy → Phone backup. The operating system and backup provider decide whether and when a backup or device transfer succeeds. Capacity limits and device settings can prevent a complete backup. Turning backup off requests future exclusion and does not delete older copies.

Use Settings → Privacy → Save to keep a complete copy, especially before changing devices, replacing data or uninstalling. The saved archive is not encrypted by the app. Store it somewhere private. An app PIN or biometric lock controls access through the app and does not encrypt exports or recipients' copies.

Deleting a saved moment normally moves it to the Bin. It remains there until you restore it or permanently delete it; complete journal exports also include Bin contents. Use Delete forever or empty the Bin to remove those local entries permanently.

Load can merge content or replace existing app data, depending on the option you choose. Replacing data or using Delete All can permanently remove content held by the app. Read the confirmation before proceeding. Copies in backups, cloud storage, messaging apps or other destinations must be managed separately; restoring an older copy can bring deleted content back.

Delete All also resets the app's preferences and protection. Phone-backup eligibility returns to its default On setting; change it again if you want future backups excluded. Usage analytics also resets to its default On setting on a subsequent app load; turn off Share app usage again if you do not want to send future events.

These practical precautions do not exclude any responsibility we have under applicable law for a defect, negligence or breach of these Terms.

6. Sharing and third-party services

The normal Share action sends an image of the whole saved entry, including content below the screen, its date, writing and visible attachments, tags and drawings, together with an app-credit message. Video and sound are static representations in that image; their original files are not sent separately. Review the entire entry and intended recipients before sharing. The current sharing flow does not offer per-item selection.

You are responsible for having any permission required to send the content and for complying with the receiving service's applicable rules. Private information visible on the page can appear in the image. Complete exports include original attachments, which may also contain embedded capture times or locations. Once another person or service has a copy, they may retain, copy or forward it. The app cannot revoke or update that copy when you change or delete the original.

Maps, place search, app stores, phone backups and destinations you choose are provided by third parties. Their applicable terms also govern their services. Maps and searches may be unavailable or inaccurate. We do not guarantee the delivery, formatting or retention of content after it is handed to another app.

We remain responsible for our own obligations under these Terms and applicable law. A third-party service's involvement does not remove those obligations.

7. Optional support payments

The Support Us feature may offer one-time contributions through Apple App Store or Google Play. These are voluntary payments supporting the developer, not subscriptions or charitable donations. We do not represent them as tax-deductible donations.

The store shows the price, currency and applicable payment terms before you confirm. Opening Support Us or choosing an amount does not itself authorise a charge. Each payment requires the store's purchase confirmation and any required account-holder approval.

A contribution does not purchase features, ownership, investment rights, a specific development outcome or a promise of perpetual support. Choosing not to contribute does not restrict your journal or export.

For billing problems or a refund request, use the refund process of the store that charged you. You can also contact us for help. Refunds, cancellations and any statutory withdrawal rights are governed by the applicable store arrangements and law. Nothing here makes every payment automatically non-refundable or waives a right the law gives you.

Deleting the app or its data does not reverse a payment. A local thank-you record is not a transferable purchase entitlement and may not survive deletion or a change of device.

8. Updates and availability

We may update the app to fix problems, improve security, meet legal requirements or develop its features. You may need a supported operating system and available device storage. Map and store features need connectivity and can incur your provider's usual charges.

We will take reasonable care in providing the app, but cannot promise that it will always work without interruption or error, or remain compatible with every device indefinitely. We will provide updates required by applicable law.

If we discontinue support or make a change that materially reduces existing functionality, we will give reasonable advance notice where practicable and required by law. Urgent security or legal changes may need to happen sooner. We will not use a change to these Terms to claim ownership of your journal or authorise its upload. Your applicable rights and remedies remain available.

9. Responsibility if something goes wrong

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or mandatory consumer rights and remedies.

Subject to those rights, we are responsible for loss or damage that is a reasonably foreseeable result of our breach of these Terms or failure to use reasonable care and skill. We are not responsible for losses that were not reasonably foreseeable, or for a failure caused entirely by circumstances outside our reasonable control where we have taken the steps the law requires.

We are not responsible for loss caused solely by your unlawful content, your misuse of the app or an independent third party's misuse of a copy you choose to share, where we have neither caused nor contributed to that loss through a breach of these Terms or a legal duty. This does not exclude liability the law places on us, including for our own handling of information, security failures or a defect for which we are legally responsible.

The app is supplied for personal use. To the extent the law allows, we do not accept liability for business losses such as lost business profits, opportunities or business interruption arising from its use.

The storage, backup and sharing explanations above describe how the app works; they do not remove remedies you have under applicable law.

10. Stopping use

You can stop using the app at any time. Save any content you want to keep before deleting app data or uninstalling. There is no account with us to close and no recurring app subscription to cancel.

We may end your licence for a serious breach of these Terms, subject to applicable law. Where a breach can reasonably be corrected, we will provide notice and a reasonable opportunity to correct it when we have a way to contact you. We do not have a remote facility to erase your local journal.

Ending use or a licence does not transfer ownership of your content, cancel rights already accrued, or prevent enforcement of provisions that by their nature continue, including payment disputes, ownership and liability provisions.

11. Changes to these Terms

We may revise these Terms for changes to the app, legal requirements or our business arrangements. We will identify the effective date and make the revised version available. For material changes, we will give reasonable advance notice through an appropriate channel where practicable, and obtain agreement where required by law.

Changes apply prospectively. A later version does not retrospectively change a completed support payment or remove rights that have already arisen. If you do not accept a material change, you can stop using the app and save your content. Nothing in this section removes a statutory remedy.

12. Law and resolving concerns

These Terms are governed by the law of England and Wales, subject to the mandatory protections of the law where you habitually live. This choice does not deprive consumers of rights that cannot be waived by agreement.

The courts of England and Wales have non-exclusive jurisdiction. You may also bring proceedings in your local courts where applicable law allows. These Terms do not require binding arbitration or waive rights to participate in proceedings available under applicable law.

Please contact us if you have a concern so we can try to resolve it. You do not have to use an informal process before exercising a legal right or contacting a regulator.

If a provision cannot be enforced, the remaining provisions continue to apply to the extent legally possible. A delay in enforcing a right does not waive it. Except where the applicable app-store licence or law provides otherwise, these Terms do not give contractual enforcement rights to another person.
